Terms of Use

These Terms of Use (the Terms) govern your access to and use of the AI Chat mobile application, related services and applications. Please read these Terms carefully before using the Service.

1. Acceptance of These Terms

These Terms form an agreement between you and ThinkaM LLC (AI Chat, we, us, or our). By downloading, accessing, creating an account for, purchasing a subscription to, or using the App, you agree to these Terms. We may update these Terms from time to time. We will notify you of material changes via an in-app message, email, or other appropriate communication channels. Your continued use of the Service after any such updates signifies your acceptance of the revised Terms. If you do not agree, you must not use the App or Services.

Our Privacy Policy explains how we collect, use, store, share, and protect personal information. It also describes data-retention practices, your privacy choices, and how to request deletion of personal information. The Privacy Policy is made available separately within the App and in the App Store listing.

2. Service Description

The Service provides AI-powered chatbot capabilities that include text and image generation, voice interaction, and integration with various third-party AI APIs to enhance functionality and other features. Specific features and capabilities of the Service may be changed, expanded, or discontinued at our sole discretion without prior notice.

Third-party service providers include (but are not limited to): OpenAI, Anthropic, Google, DeepSeek, Mistral AI, Z.AI, xAI, FLUX, Stability AI, and Qwen AI.

3. Definitions

  • App means the AI Chat iOS mobile application.
  • Services means the App and its AI-powered features, including chat, writing assistance, translation, text and webpage summaries, voice features, image generation, and related tools.
  • User, you, and your mean the person using the Services.
  • Input means any text, images, files, links, prompts, voice recordings, instructions, or other material that you submit to the Services.
  • Output means any text, images, summaries, translations, or other material generated by the Services in response to Input.
  • Content means Input and Output together.

4. Eligibility, Age, and Account Responsibility

You must be at least 13 years old, or the minimum age required to consent to online services in your country, to use the Services. If you are under the age of 18, you may use the Services only with the permission of a parent or legal guardian.

If the Services require an account, you must provide accurate and complete information and keep it up to date. You are responsible for keeping your account credentials secure and for all activity that occurs through your account. Do not share your account with another person. Notify us promptly at thinkamllc@gmail.com if you believe that your account has been accessed without authorization.

If you use the Services on behalf of a business or organization, you confirm that you have authority to accept these Terms for that entity.

5. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App and Services for their intended purpose on Apple-branded devices that you own or control, as permitted by the applicable Apple usage rules.

This license does not give you ownership of the App, Services, or any of our intellectual property.

6. Acceptable Use and Prohibited Conduct

You must use the Services lawfully and responsibly. You must not, and must not help another person to:

  • violate applicable laws or regulations;
  • infringe, misappropriate, or violate another person's intellectual-property, privacy, publicity, or other legal rights;
  • create, upload, request, distribute, or facilitate illegal, harmful, abusive, harassing, hateful, fraudulent, deceptive, or sexually exploitative content;
  • exploit, endanger, or harm minors;
  • create or distribute malware, phishing content, spam, scams, or content intended to obtain unauthorized access to systems, accounts, or data;
  • interfere with, disrupt, overload, or compromise the security or availability of the Services;
  • bypass or attempt to bypass safety measures, technical restrictions, access controls, rate limits, or security features;
  • scrape, harvest, or programmatically extract data or Output from the Services without our written permission;
  • reverse engineer, decompile, disassemble, modify, copy, rent, lease, sell, or redistribute the Services, except where applicable law does not allow a restriction;
  • falsely represent AI-generated Output as human-generated where doing so would mislead another person;
  • use Output to make decisions about an individual that produce legal or similarly significant effects, including decisions about employment, education, housing, insurance, credit, healthcare, legal services, or financial services, without appropriate qualified human review.

We may restrict, suspend, or terminate access to the Services if we reasonably believe that you have violated these Terms, your use creates risk or harm, or we are required to do so by law.

7. Your Content

You retain any ownership rights you have in your Input. You are responsible for all Input you submit and for your use of Output. You represent and warrant that you have all rights, licenses, permissions, and consents needed to submit Input to the Services and allow us to process it as described in these Terms and the Privacy Policy.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, transmit, and use Content only as needed to provide, maintain, secure, and enforce the Services; comply with applicable law; and protect the safety and integrity of the Services. We may use service providers to process Content on our behalf, as described in the Privacy Policy.

Do not submit confidential, highly sensitive, or personal information unless you understand and accept how it will be handled under our Privacy Policy.

8. AI Output and Your Responsibility

AI systems are probabilistic and may produce Output that is inaccurate, incomplete, misleading, offensive, or unsuitable for your purpose. Output may also be similar or identical to output generated for other users and may not be unique.

You may use Output for lawful purposes, subject to applicable law and third-party rights. Before using, sharing, publishing, or relying on Output, you must review it for accuracy, appropriateness, and legal compliance.

The Services and Output are not a substitute for professional advice. Do not rely on Output as your sole source of truth or as medical, legal, financial, tax, safety, or other professional advice. Seek qualified professional advice for decisions that may materially affect you or another person.

9. Intellectual Property

We and our licensors own all rights, title, and interest in and to the App and Services, including their software, design, interfaces, trademarks, branding, and content supplied by us. Except for the limited license expressly granted in these Terms, no rights are granted to you. You may not reproduce, modify, distribute, sell, license, or commercially exploit any part of the Service without our express prior written consent.

If you send us feedback, suggestions, or ideas about the Services, you grant us the right to use them without restriction or compensation to you.

10. Paid Subscriptions and Apple In-App Purchases

Some features of the Services are available only with a paid subscription or in-app purchase. The available plans, prices, billing periods, and included features will be displayed in the App Store or App before you complete a purchase.

Purchases made through the Apple App Store are processed by Apple and are subject to Apple's applicable terms and policies. Payment will be charged to your Apple ID account when you confirm the purchase. Unless otherwise disclosed at the time of purchase, subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel a subscription through your Apple ID subscription settings. Deleting the App does not cancel an active subscription. All purchases and subscriptions are generally non-refundable. Refund requests will be reviewed on a case-by-case basis and granted solely at our discretion, or in accordance with the policies of the relevant app store (e.g., Apple App Store guidelines) and applicable consumer protection laws. Please note that we do not directly process refunds for in-app purchases; such requests must typically be made through the app store from which the purchase was made.

We may change subscription prices or plan features from time to time. Any change will apply to a future billing period and will be communicated as required by applicable law or App Store requirements.

We may occasionally offer free trial periods for certain subscription plans. If you subscribe to a free trial, you will be required to provide payment information. If you do not cancel your subscription before the free trial period ends, it will automatically convert into a paid subscription, and your account will be charged the applicable fee for the chosen plan. Free trials are limited to one per user unless otherwise specified.

11. Apple App Store Terms

The App is licensed, not sold, to you. These Terms are between you and ThinkaM LLC, not Apple Inc. Apple has no obligation to provide maintenance or support for the App.

ThinkaM LLC, not Apple, is responsible for addressing claims relating to the App, including product-liability claims, claims that the App does not comply with applicable legal or regulatory requirements, consumer-protection claims, and third-party intellectual-property infringement claims. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Third-Party Services and Content

The Services may include, access, or interact with third-party services, websites, content, models, APIs, or app-store platforms. Those third parties operate under their own terms and privacy policies.

We do not control and are not responsible for third-party services or content, including their availability, accuracy, security, or practices. Your use of third-party services is at your own discretion and risk.

13. Privacy

Our Privacy Policy, made available separately within the App and in the App Store listing, describes our collection and use of personal information in connection with the Services. It identifies the data we collect, how we use it, when we share it, how long we retain it, and how you can exercise applicable privacy rights. By using the Services, you acknowledge that you have read the Privacy Policy.

14. Availability, Updates, Suspension, and Termination

We may update, modify, add, remove, suspend, or discontinue any part of the Services at any time. We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or compatible with every device or operating-system version.

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if we are required to do so by law, or if your use creates risk or harm to us, users, or third parties. Where appropriate and legally permitted, we will provide notice before termination.

15. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE AVAILABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKAM LLC AND ITS AFFILIATES, LICENSORS, DISTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited. If the law in your jurisdiction does not allow a disclaimer or limitation in this section, it applies only to the extent permitted by that law.

16. Governing Law and Disputes

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which ThinkaM LLC is established, without regard to conflict-of-law principles, unless applicable consumer-protection laws require otherwise.

Before starting formal legal proceedings, you agree to contact us at thinkamllc@gmail.com and give us a reasonable opportunity to resolve the issue informally.

If a dispute cannot be resolved informally, it may be brought before a court or other forum with jurisdiction under applicable law. Nothing in these Terms limits any right that cannot lawfully be waived, including a consumer's right to bring a claim in a competent court where applicable law gives that right.

17. Changes to These Terms

We may update these Terms to reflect changes to the Services, applicable law, security requirements, or our business practices. If a change is material, we will provide reasonable advance notice through the App or another appropriate method.

Updated Terms will apply from the effective date stated in the notice. If you continue to use the Services after that date, you accept the updated Terms. If you do not agree, you must stop using the Services.
